Terms of Service

1. Acceptance of Terms
By accessing or using Levelynx products, services, website, or any associated platforms (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and Levelynx.
2. Description of Services
Levelynx provides flood and water level monitoring services, including but not limited to:
- Water level monitoring using 60GHz radar sensor technology
- Data collection, processing, and delivery via cloud-based platforms
- Automated alerts and notifications via phone calls, SMS, email, and siren activation
- Connectivity services via cellular and satellite communication systems
- Integration with third-party notification platforms such as WeatherCall
Levelynx provides informational and alerting services only. The Services are intended to supplement, not replace, comprehensive emergency preparedness and response planning.
3. No Guarantee of Performance
While Levelynx makes best efforts to provide reliable monitoring and alerting services, you acknowledge and agree that:
- The system is designed with redundancy but is not fail-proof
- Electronic components, sensors, and hardware may malfunction or fail
- Cellular and satellite communications networks may experience outages, delays, or degraded performance
- Software systems may contain errors or experience failures
- Power sources, including batteries and solar panels, may fail
- Third-party services upon which Levelynx relies may experience failures or service interruptions
- Environmental conditions may affect sensor accuracy or communication reliability
Levelynx does not warrant that the Services will be uninterrupted, timely, secure, or error-free.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Levelynx shall not be liable for any damages arising from system failure, delay, inaccuracy, or interruption of the Services, regardless of cause.
- Levelynx shall not be liable for loss of life, personal injury, property damage, economic loss, or any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the use or inability to use the Services.
- Users acknowledge that flood monitoring systems are only one component of comprehensive emergency preparedness and do not guarantee protection from flood events or their consequences.
- Users assume all risk associated with reliance on the Services for flood monitoring, alerting, or any other purpose.
In no event shall Levelynx's total liability exceed the amount paid by the user for the Services during the twelve (12) months preceding the claim.
5. No Life-Safety Guarantee
LEVELYNX IS NOT A LIFE-SAFETY SYSTEM.
- The Services are not a substitute for emergency services, official evacuation orders, or government-issued warnings
- Users must not rely solely on Levelynx for life-safety decisions
- Users must maintain independent safety protocols, emergency response plans, and evacuation procedures
- Users are responsible for monitoring official weather services, emergency management communications, and other authoritative sources
Levelynx strongly recommends that all users maintain comprehensive emergency preparedness plans that do not depend solely on any single monitoring or alerting system.
6. Third-Party Dependencies
Levelynx Services rely on third-party providers and infrastructure, including but not limited to:
- Cellular network carriers
- Satellite communication providers
- Alert delivery platforms (including WeatherCall)
- Cloud infrastructure and hosting services
- Hardware component manufacturers
Levelynx is not responsible for failures, outages, delays, or performance issues caused by third-party providers. Users acknowledge that third-party service availability is outside of Levelynx's control.
7. User Responsibilities
Users of Levelynx Services are responsible for:
- Proper installation and positioning of sensors and equipment according to Levelynx guidelines
- Regular inspection and maintenance of equipment as recommended
- Setting appropriate alert thresholds for their specific locations and conditions
- Responding appropriately and promptly to alerts and notifications
- Training staff, personnel, and other users on system operation and emergency procedures
- Maintaining backup communication and alerting methods
- Ensuring accurate contact information is maintained in the system
- Complying with all applicable laws and regulations
8. Subscription and Payment Terms
Levelynx Services are provided on a subscription basis. By subscribing to the Services:
- You agree to pay all applicable subscription fees as specified in your service agreement
- Subscriptions automatically renew unless cancelled in accordance with your service agreement
- Hardware provided as part of the subscription remains the property of Levelynx unless otherwise specified
- Non-payment may result in suspension or termination of Services
Specific pricing, billing cycles, and payment terms are detailed in individual service agreements.
9. Termination
Levelynx may suspend or terminate Services under the following circumstances:
- Non-payment of subscription fees
- Violation of these Terms of Service
- Misuse of the Services or equipment
- Upon written request by the user with appropriate notice
- At Levelynx's discretion with reasonable notice
Upon termination, users must return any Levelynx-owned equipment as specified in the service agreement.
10. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
11. Changes to Terms
Levelynx reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to the Levelynx website. Continued use of the Services after changes are posted constitutes acceptance of the modified Terms. Users are encouraged to review these Terms periodically.
